Art. 1: DEFINITIONS
The online store is referred to as LOVEGOUR.COM.
The customer is the individual or legal entity that places an online order.
The internet is a set of interconnected networks located worldwide.
The identifier refers to the combination of the username and password that allows the customer to identify themselves on the network.
Art. 2: OBJECT
The contract aims to define the conditions and modalities under which LOVEGOUR.COM makes its products available to the customer.
The online order displayed forms an integral part of this contract. Any order of one or more LOVEGOUR.COM products online implies acceptance of these terms and conditions.
Art. 3: PRODUCTS
After placing the order online and validating the payment for the product, the customer will receive an email with the purchase details and specific instructions for verification. This email allows access to the customer account.
All products offered by LOVEGOUR.COM are authorized for consumption according to current legislation.
3.1 - Returns:
All our products are shipped well packaged and protected, so they should arrive in optimal condition. If any issues are detected with the packaging, such as dents or breaks upon receipt of the shipment, please indicate this on the acknowledgment of receipt from the shipping company. If this is not noted, returns will not be possible.
We accept returns of any product in our catalog within 7 calendar days from the receipt of the order, provided the products are returned EXACTLY as they were sent, with the packaging sealed and in perfect condition. Return shipping costs are the responsibility of the buyer, and once we receive the returned merchandise, we will proceed with the refund after verifying that all the products match the original order.
3.1.1 - Returns of Ham and Palettes:
All hams and paletas available for purchase on our online store are guaranteed. Returns will only be accepted under the following conditions:
- Unpleasant odor after opening the product.
- Excessive fat content. For Iberian products, a fat percentage of 40-50% of the total weight is considered normal.
- Once opened, returns will not be accepted if the weight difference exceeds 10% of the initial total weight.
To ensure a correct return, the original packaging and wrapping must be preserved. Returns for any other reason, such as curing point, salt point, or appearance of the product, will not be accepted. If you have preferences regarding the curing point, please indicate this in the order comments.
3.1.2 - Returns of Other Products:
The rest of our products are of the highest quality/price and are also guaranteed. Returns will be accepted if the product has a bad odor or overall poor condition; returns will not be accepted for products that the customer does not like based on appearance or aesthetics. Art. 4: CUSTOMER'S RESPONSIBILITY
The customer agrees to provide accurate and correct information when purchasing the products. They also agree to notify LOVEGOUR.COM of any changes to the provided data and will be solely responsible for any issues that may arise from incorrect data.
The customer must maintain a valid email address. The data will be updated through the interface provided for this purpose.
The customer agrees not to attempt to penetrate the computer systems of LOVEGOUR.COM.
Art. 5: LOVEGOUR.COM RESPONSIBILITIES
LOVEGOUR.COM agrees to use all means at its disposal to supply the products purchased by the customer after payment has been validated. This is a commitment concerning means, not results.
5.1 - Accessibility:
Due to the characteristics and limitations of the internet, which the customer acknowledges, LOVEGOUR.COM is not responsible for the speed of access from other pages in the world, nor for the slowness or difficulty of access to the customer's page. LOVEGOUR.COM is also not responsible if emails or forum messages are not forwarded due to the inherent limitations and characteristics of the internet. LOVEGOUR.COM reserves the right to temporarily interrupt access to its services for maintenance or improvements, without this giving rise to any compensation. However, LOVEGOUR.COM commits to doing everything in its power to minimize such interruptions.
5.2 - Security:
LOVEGOUR.COM is not responsible for any malicious intrusion into the customer's web space or hacking of the customer's email inbox, despite all the security measures adopted by LOVEGOUR.COM.
5.3 - Denial of Warranties:
LOVEGOUR.COM offers its services based on availability. LOVEGOUR.COM expressly denies any other warranties, including those of market value or suitability for a specific purpose. LOVEGOUR.COM is not responsible under any circumstances for direct, indirect, special, or incidental damages. Even if the customer informed LOVEGOUR.COM of the possibility of such loss or potential damages.
5.4 - Force Majeure:
LOVEGOUR.COM is not responsible for any delays or non-fulfillment if caused by an event of force majeure, as recognized by jurisprudence. The force majeure event suspends the obligations under this contract for its duration. However, if the force majeure event lasts longer than 30 consecutive days, either party may rescind this contract by sending a registered letter within 8 days of notifying such a decision.
5.5 - Indemnification:
The customer agrees to defend, indemnify, and hold LOVEGOUR.COM harmless from any loss, damage, or claim (including attorney's fees) related to the use of the service provided by LOVEGOUR.COM under this contract.
5.6 - Other:
The customer will indemnify LOVEGOUR.COM for any costs it incurs in any cause for which the responsibility is attributable to the customer, including lawyer's fees and costs, even if the judicial decision is not final.
The customer is prohibited from accessing, modifying, or viewing the configuration, structure, or files of LOVEGOUR.COM's servers. Any issues arising from negligent actions by the customer will result in civil and criminal liability for which the customer will be responsible.
Art. 6: MODIFICATION OF THE CONTRACT
LOVEGOUR.COM reserves the right to modify this contract. In such cases, LOVEGOUR.COM must notify the customer of the scope and content of the modifications at least 15 days before they come into effect. If the customer does not accept these changes, they may terminate the contract early. Otherwise, the new conditions will be deemed accepted by the customer.
Art. 7: COMPETENCE AND PRICING
The prices of the proposed products are those indicated in the order. LOVEGOUR.COM may modify its prices at any time without prior notice. LOVEGOUR.COM reserves the right to immediately apply a new tax or an increase in existing tax rates.
Art. 8: LEGISLATION GOVERNING THIS CONTRACT
This contract is governed by the Spanish Retail Trade Law (Law 7/1996) and the General Contracting Conditions Law (Law 7/1998).
Art. 9: ACCESS BLOCKING
LOVEGOUR.COM, in accordance with the provisions of the LSSI of 34/2002, reserves the right to block access to content at any time without notice if it is deemed to violate Spanish or international laws.
Additionally, LOVEGOUR.COM is not responsible for external content that is transmitted, hosted, or accessed.
Art. 10: SUSPENSION OF SERVICE AND DAMAGES
In the event of a temporary suspension of the customer's website or service, whether internal or external, or voluntary for service improvement, this cannot be used as a reason for a claim for damages. LOVEGOUR.COM commits to taking all necessary measures for service restoration as soon as possible.
Art. 11: COMPETENCE IN CASE OF LITIGATION
These General Terms are governed by Spanish law. The parties agree, at their choice, to resolve conflicts by submitting to the courts of the customer’s domicile, with the waiver of any other jurisdiction.
Art. 12: PERSONAL DATA PROTECTION
For the purposes of the Organic Law on Personal Data Protection and its amendments, the collection and processing of these data are intended for maintaining the contractual relationship between the parties, management, administration, provision, expansion, and improvement of the services provided.
The customer may exercise their rights of access, rectification, cancellation, and opposition by contacting the responsible party at the address above.
Art. 13: COMMERCIAL COMMUNICATIONS
The customer consents to receiving commercial communications and promotional offers from LOVEGOUR.COM, governed by this Law on Information Services, its own regulations, and the applicable commercial and advertising laws.
The customer may at any time contact us by email, fax, or phone to stop receiving this information.
Art. 14: USE OF BRANDS AND LOGOS
LOVEGOUR.COM may use the customer's image for promotional purposes in any media with express written consent.
The customer may not use the LOVEGOUR.COM brand for commercial purposes or any other purpose without the express consent of its owner.
